Cleve "Sarge" Foster is on death row because of Texas' law of parties and he is innocent. He was sentenced to death in 2003 for the murder of Nyanuer "Mary" Pal. His co-defendant, Sheldon Ward, was tried and sentenced to death as the triggerman.
Ward, who died on death row of natural causes, gave four statements asserting that Sarge was not involved in Pal's murder. Sarge has had at least three and maybe four execution dates and in Jan of 2011 got a stay from the US Supreme Court as a result of litigation raising questions about his innocence and the ineffectiveness of his appointed counsel who failed to raise that issue. The Supreme Court subsequently lifted the stay without any comments on the merits.
Texas has set yet another execution date for Sept 25. His attorney is Maurie Levin, an adjunct professor with the UT Capital Punishment Center.
