Roy: Ok I will answer each question as briefly as I can but beware I ramble!
1. Roy, please tell us how long you have been on death row, and what you are charged and convicted of.
I was convicted of killing two Colombian men, the police said were cousins, on 9/15/95 – so 11 years on the row. There were other murders in the case they did not charge me with. In a nutshell – I was a front for a large Colombian cartel; they used my air conditioning shop, t-shirts, vehicles and company name as their employer (for a cover). I let them use my a/c shop to unload truckloads of cocaine and they brought me the money to count, separate by denominations, package and load in vehicles to be transported into Mexico and New Colombia. I made some trips carrying the money.
In mid 1994 (April) two Colombians (deceased now) came to my home and demanded my signature on a form (my a/c company worksheet) saying I accepted XX amount of money. They had no money with them. They were trying to either set me up or just screw the big boss (Cuz). I said I would not do it. They immediately threatened to kill me and my family. I got them away from my house by lying – saying I would help – and called Cuz. He sent interrogators and hit men to “take care of the problem”. I allowed them to use my shop for interrogations and I rented hotel rooms “in my own name” (obviously I thought it would be resolved peacefully) for the five men to be “held against their will”. I testified to that but refused to give real names etc…so I’m here, I did NOT shoot or kill anyone but the state built their case saying I did and couldn’t back down once the ballistics evidence proved their eyewitness (NOT!) had lied, so they suborned perjured testimony and tried to hide that 2 guns were used (3 in all – other victims) to kill the Buitragos, their alleged eyewitness testified it was me – with one gun. (see I ramble – sorry)
2. Do you feel your representation was adequate?
My legal representation was deplorable, they believed the prosecutions case so they never even looked for my multiple alibi witnesses – I was at a club with people doing coke and driving when the shootings occurred and they – therefore – could not re-group when the prosecutor was caught withholding the ballistics evidence that completely destroyed his case. My state habeas attorney was a total joke. He never answered a letter in over 4 years, refused to visit and refused to file actual innocence claims; oh he refused to hire an investigator and said he told it all on the phone. I got 3 federal habeas attorneys dismissed due to all of them being uncaring and incompetent, all stepped down to be a judge. One got dismissed under 28 USC 2261 (e) – look it up “ineffective and incompetent” and he is still doing DP appeals in Texas!!!
3. I understand you have been given an execution date of March 29th, 2007. Do you feel you will be given a stay of execution?
I would say my odds are maybe 2% of a stay… better than zero but we will see. A Mexican lady wrote in 5/06 saying she knows I didn’t do this and knows who did. She was part of the drug group and fears for her life after being threatened. It may not be enough – in Texas. Also new proof they withheld ballistics evidence proving it was two guns – where my idiot expert couldn’t ascertain the true facts.
4. The Polunsky Unit in Texas where you are being housed has been called "The Texas Death Camp" by some, why is this?
Polunsky cells are not bad – but 22+ hours a day in them is barbaric, the major problem is despotic new wardens and rank. Most guards are ok but like in any society, some are sadistic and feel they need to make us miserable every day.
5. Please tell us about the conditions at Polunsky Unit.
Bullying; we have to follow rules but guards can do whatever they want with impunity, intimidation tactics by rank, cold food (like I care now) the rudeness to loved ones is unacceptable, messing with our mail etc., done with impunity and if a female guard says you masturbate or talk dirty you are automatically found guilty. The grievance system is a total joke – I've won 2 out of 100’s, kept dirty “unless visitors – zoo watchers are coming”
6. Do you feel the prison staff is well trained, and act as compassionate, human beings?
Trick question right? Well trained? Most can't brush their teeth by themselves. No, they are far from being well trained.
7. Are you being supported by friends and family at this time?
Yes I am blessed to have loving friends and family who support me emotionally, financially and spiritually.
8. What are your general thoughts about Capital Punishment, and what should the public know?
You won't like this – even though I was wrongfully convicted and “remarkably” sentenced to death (no other convictions, abuse charges etc…in my life, not DUI”S etc) I still believe some crimes deserve a death sentence, if someone raped and murdered my daughter, (nowadays) son, mother, sister, lifelong friend etc., I would want them to pay the ultimate price. But since my case I've said “confessed felons, DNA proving it” multiple witnesses and/or weapon proving the crime etc… should result in a conviction and the D.P, I've asked many anti-DP or abolition group members what they would want if one of their loved ones died a horrendous death. You would be surprised at the percentage that rethinks their position.
9. What about the victims in the crime you were convicted of, what about their friends and family? Is there anything you wish to say about this?
The Colombian victims in my case were drug dealers and murderers. They knew that on any given day, as I did, that they would be put in prison or die. Their family and friends knew it too. I pity any fatherless children from this case – but they did not die by my hand AND they would have killed my family, so the jurors never saw remorse or sorrow for the victims from me, why should I show those emotions? If it wasn’t them – it would be me and my family, but I made a phone call, not fired a gun.
I guess I would say: “Sorry you ended up with the type of parents you did and lived with the fear they would die due to their illegal activities all those years. I wish you a peaceful life and stay out of their business because it ends in death or prison”.
10. What is it like to count down the days to your execution?
My execution will be an escape from this man made hell on earth. It will be a release. I know without a doubt that this earthly existence is not all there is for me/us. I look forward, especially so to being in paradise – so the days don’t mean much. It's watching the nervous “unbelievers” that is troubling.
11. How are inmates treated on death watch?
Death watch used to be ok – until warden Hirsch changed all the rules. 4 guys are being kept on level 2 where they have limited rec, visits, no commissary, no radio or hot pot etc NO special visits, why??? They refuse to cut their hair or got caught drinking wine or smoking weed, so abuse them the last days of their lives! That’s punk_ _ _ Hirsch! Sleep deprivation is a huge problem; we can only rec in “A” section. Do the math – 12+ guys times 2 hours (if all level one) equals 24 hours a day of door and gate slamming, yelling out orders, cell searches, guards trying to deny rec or showers “because it's too late”, and no time to sleep!! Major Nelson helps some but not others to change visits, get level one back etc
12. There was a recent suicide of one of the inmates on death watch, how does something like this happen?
I got here weeks after the suicide by Michael Johnson. Anyone can commit suicide – even with a guard sitting in a chair in front of the cell. Their procedures make them have to “suit up” to come into the cells, 15-20 minutes; you can bleed out or die of strangulation from hanging, not my thing!
13. At this time, if there is something you would like to say, please do so.
To young kids, teenagers and all adults – any race, religion, or sexual preference – stay away from drugs. Life is a gift and abusing yourself “for a short high” is so stupid it is unconscionable that so many people do it, in my heart I know I am going to die – not for the murders in this case, but for helping the Colombians bring in their poison to ruin lives and destroy families. I know I'm forgiven for my sins but I still live with the pain that my greed for money, a thrill, getting high, unlimited sex, etc has caused. I sincerely ask all of you who overcame addiction and survived it intact will forgive me for my sins.
14. How can The Abolishment Movement, or general public help you?
Help stop the madness, $500 billion in Iraq and “the drug war” kills more people and destroys more lives than 911 or Iraq each month. I don’t know the way to stop it but I hope people will learn from my murder, it actually only takes once of using a drug to ruin your life. I became extremely addicted after one night of cocaine, drinking and the free flowing sex of women who did it with me; it was the beginning of the end. So, in conclusion (thank God huh!) I think focusing on stopping “ the thing that lands a good 80% of the prisoners here” drugs would be a huge step to ending the D.P and lower the murder rate to what is was decades ago “before the invasion of cheap drugs”.

I cannot seem to be succinct in anything. It's a built in flaw. I do love mail so “wad me up” if you can these last 24, oops, it’s 12.10am so 23 days see – I usually don’t watch the days, It's only when I write letters that I'm reminded of how much time I have left.
FYI – IF my pre se work got any action at all it would make court approved attorneys look like idiots, so, I have a higher hurdle then most, BUT I'm good at what I do so it's always possible.
Tarot cards and astrology, I like you!!! I love near death experience reports, communications with “the other side” anything on ancient Egypt and the Pyramids etc. There is a new life once we leave these earthly vessels behind. I know – I've talked with my friend Terry almost 40 years. He died of bone cancer in 1967. HE saved me from dying several times, it's real Dee guaranteed! Like in “ghost” (Demi Moore, Patrick Swayze & Whoopie Goldberg) – you take the love with you, I know it. Hope you do too. I hope to hear back, have a wonderful, happy and productive life, you will be in my thoughts and prayers.
